1 – YOUR ACCOUNT

If you create an account (personal user ID or username) on the ILC website – officinabvmilano.com – you are fully responsible for maintaining the confidentiality of your username and password and for restricting access to your password, and you agree to accept responsibility for all activities that occur under your account, unless such activities or purchases are made by an unauthorized third party who has gained access to your account through reasons other than your obvious negligence or carelessness.

It is your responsibility to use antivirus software on any material downloaded from this Site and to ensure that such software is compatible with your equipment. In circumstances where you provide us with information relating to third parties, you warrant that you have received the consent of that third party in relation to such disclosure and that the third party has been informed of and accepts our Privacy Policy and Cookie Policy and the uses we may make of such information. 2 – OUR COMMERCIAL POLICY

ILC Srl (the Seller) offers products for sale on officinabvmilano.com and its e-commerce services are available exclusively to its end users, i.e. "Consumers," meaning any natural person acting for purposes unrelated to their commercial, entrepreneurial, or professional activities. If you are not a Consumer, please do not purchase any products on the ILC website.

The Seller reserves the right not to process orders received from users who are not "Consumers" and any other orders that do not comply with the Seller's commercial policy. These General Terms and Conditions of Sale exclusively govern the offer, transmission, and acceptance of purchase orders relating to products on officinabvmilano.com, between Users of officinabvmilano.com and ILC Srl.

The General Terms and Conditions of Sale do not govern the provision of services or the sale of products by third parties that are linked to our website via banners or other hyperlinks. Before placing orders and purchasing products and services from such third parties, we recommend that you check the terms and conditions of the third party. services provided by third parties or for the execution of e-commerce transactions between users of officinabvmilano.com and third parties.

3 – ACCEPTANCE OF THE ORDER

In order to purchase the Products, you must:

• read and accept these Terms and Conditions of Sale;
• provide all details requested on the order form, such as name and address, telephone number, email address, shipping address if different, payment details, and any other information we may need to deliver the product, such as a suitable delivery address;
• be legally capable of entering into binding contracts;
  be the owner or authorized holder of a valid debit/credit card.

To place an order, simply click on the ADD TO CART button to add a product, then follow the instructions during the checkout process to complete your order. You will be given the opportunity to review your order(s), read and accept these Terms and Conditions of Sale and Returns and Refunds Policy, check the total price of your order(s) and the information you have provided, and correct any input errors before confirming your order(s).

Please note that unfortunately ILC Srl is currently unable to ship worldwide, so we apologize for any orders we may be forced to refuse due to the shipping address.

Please also note that ILC products are shoes, belts, and accessories made from different types of leather, therefore ILC will comply with all applicable regulations for sales outside the European Community, where required.

4 – PROCESSING OF ORDERS, FORMATION AND EXECUTION OF THE CONTRACT

Once you have submitted and confirmed your order(s) via the ILC website, ILC Srl will send an email to the email address you provided to confirm receipt of your order(s) ("Order Confirmation") and specify the details of the Product(s) ordered. The ORC is responsible for the delivery process, so if you find any discrepancies with your order or your wishes, please contact us by email (info@bvmilano.com) within 2 working days so that we can cancel or modify your order.

ILC Srl may decide not to accept any order at its sole discretion, including, without limitation, cases of pricing errors, unusual orders, and orders that ILC suspects were not placed in good faith.

After receiving your order(s), ILC Srl will verify that the Product(s) in question are available in stock. A contract for the sale of Products between you and ILC Srl will only be concluded when ILC Srl sends you an email confirming that all or part of the Products are available and have been shipped ("Shipping Confirmation"). Please note that a contract is now concluded when ILC sends the Shipping Confirmation, regardless of whether or not you receive such email.

The contract for the sale of Products shall only cover those Products whose shipment has been confirmed in the Shipping Confirmation. ILC shall not be obliged to supply any other Products that may have been part of Your order until the shipment of such Products has been confirmed in a separate Shipping Confirmation. In the Order Confirmation, you will receive a copy of these Terms and Conditions of Sale, however, you are encouraged to download, save, and/or print a copy of your Order Confirmation and these Terms and Conditions of Sale for your records.

Orders can be modified or canceled before the delivery process begins by contacting us by phone at +393911749461, Monday through Friday from 11:00 a.m. to 6:00 p.m., or by email at info@bvmilano.com.

Once the delivery process has begun and a tracking number has been issued, orders can no longer be modified. However, you have the option to refuse delivery, in which case the Products will be returned to ILC Srl, or to accept delivery and then return the Products to ILC Srl in accordance with Returns and Refunds.

Once you have received the Shipping Confirmation, it will be too late to prevent the Products from being shipped to you. If you wish to cancel your order after this point, please refer to Returns and Refunds or immediately send an email to info@bvmilano.com indicating the order you wish to cancel. In this case, if it is possible to stop the delivery, we will only refund the value of the products.

5 – PRICES, SHIPPING, AND HANDLING

The price charged for a Product will be the price in effect at the time the order is placed and will be indicated in the Order Confirmation and Shipping Confirmation.

In the event of a pricing error, whether on the ILC website, in an Order Confirmation, or otherwise, you agree that ILC has the right to correct such error and charge the correct price or cancel the order. If the actual price is higher than the amount shown on the Order Confirmation, ILC Srl will notify you of the correct price and give you the option to proceed with the order or cancel it. Your sole remedy in the event of such a pricing error is to cancel the order.

You acknowledge that even after ILC Srl has sent you a Shipping Confirmation, if the pricing error is obvious and could reasonably have been recognized by you as an error, ILC Srl will have no obligation to supply you with the Product(s) in question at the incorrect (lower) price.

Product prices include VAT and/or other applicable taxes but do not include shipping and handling charges. Separate charges for shipping and handling (and the applicable VAT or other taxes) will be clearly displayed on the screen before you complete your order and confirmed in your order confirmation.

The prices of Products, shipping and handling charges are subject to change at any time, but changes will not normally affect orders for which we have already sent you a Shipping Confirmation (except in the case of an obvious pricing error as described above).

6 – PAYMENTS

Payment for your order, including all applicable taxes, shipping costs, and other charges, must be made using one of the methods indicated on the order form, i.e., you must provide all the billing information required to complete your purchase. If ILC Srl does not receive the appropriate authorization from your card or payment service provider, ILC Srl reserves the right to refuse your order.

In the event of payment by credit/debit card, all details (e.g., card number or expiration date) will be sent via encrypted protocol to banks and other authorized financial operators that provide remote electronic payment services, without third parties being able to access them in any way. These details will not be used by the Seller except to complete the procedure relating to your purchase or to issue refunds in the event of returns in accordance with your right of return, or to report cases of fraud to the police.

7 – TAX INFORMATION

Please note that purchases on the ILC website – www.bvmilano.com – are reserved for end consumers, therefore our prices always include VAT or any other applicable taxes.

ILC Srl issues an invoice for every order placed on the ILC website. The document will be sent as an attachment in the Shipping Confirmation email. Please note that once the order has been confirmed, it is not possible to change the details entered and therefore it is not possible to issue a new invoice.

8 – PAYMENT SECURITY

On the ILC website, every purchase is made with maximum security thanks to the use of the PayPal payment platform https://www.paypal.com/uk/webapps/mpp/paypal-safety-and-security, which provides its services in accordance with the PCI DSS (Payment Card Industry Data Security Standard), a set of requirements imposed by the industry on any company that manages, processes, or stores credit cards, regardless of the size or location of the company.

In addition, our payment platform complies with 3D Secure 2 (3DS2), the new industry standard for customer authentication, to meet the Strong Customer Authentication (SCA) requirements of PSD2.

Please note that cardholder data is managed in PayPal using multiple encryption keys with split knowledge and dual control. A data thief would not be able to use information stolen from a database without also having the key. This data store cannot be accessed via the Internet.

ILC Srl makes every reasonable effort to ensure the availability of Products ordered from the ILC officinabvmilano.com website. However, Products are made available for purchase on a "first in, first out" basis and are only available while stocks last.

10 – PRODUCT INFORMATION

It is your responsibility to ensure that the Products you purchase are compatible with their intended use. Therefore, please use the information on the website or contact ILC Srl customer service to verify compatibility.

ILC Srl makes every reasonable effort to ensure the best possible match between the product shown in the images on the website and each individual product shipped, but since all products are handmade/made with natural materials, there may always be slight differences between the product displayed and the one delivered to you, particularly with regard to colors, as the actual color you see will depend on your computer system and device. Regardless of this reasonable and unavoidable difference, if the Products you have received do not match those you ordered, or if your delivery is incomplete or damaged during transport, please contact ILC Srl for assistance without delay, by email or telephone.

The ILC website may contain typographical errors, inaccuracies, or omissions that may relate to product descriptions, pricing, and availability. We reserve the right to correct any errors, inaccuracies, or omissions and to change or update information at any time without prior notice (even after you have submitted your order).

In the event of any discrepancy between the content of the ILC website and that of any other website or source of information, the compatibility of the Products as shown on the ILC website at the time of purchase shall be deemed to be the only reliable source.

11 – PROMOTIONS

From time to time, ILC Srl may offer sweepstakes, contests, or other promotions that require you to submit material or information about yourself. Please note that sweepstakes, contests, or promotions offered through the ILC website may be, and often are, governed by a separate set of rules that, in addition to describing such sweepstakes, contests, or promotions, may have eligibility requirements, such as certain age or geographic restrictions, terms and conditions governing the use of the submitted material, and supplemental disclosures about how your personal information may be used. 12 – OWNERSHIP AND TITLE OF THE PRODUCTS

Ownership of the Products will only pass to you once ILC Srl has received full payment in relation to your order, including taxes, shipping, and all other charges. Until that time, ILC Srl retains full legal ownership of the Products.

The Products will be at your risk and responsibility from the moment you physically take possession of them.

13 – DELIVERY

Products available in stock purchased on officinabvmilano.com are normally delivered (standard delivery) within 7 working days from the date of order in Italy and within 10 working days for all other destinations, provided that payment is received before 2:00 p.m. on the day the order is placed.

Shipments to certain countries of materials protected by the CITES treaty in Washington require specific documentation, the preparation of which may delay standard shipping times. In this case, we will send you a notification in the shipping confirmation email.

We are currently unable to ship orders to General Deliver and PO Boxes.

Deliveries may be subject to slight delays during holiday periods (generally the entire month of August and December from December 20 to January 7), and couriers do not deliver on December 25, December 26, January 1, or other national holidays and weekends, but products will still be delivered within 30 days of shipment confirmation in accordance with the terms provided for by applicable laws.

If, for any reason, ILC Srl is unable to deliver your order within the period specified in the Shipping Confirmation, ILC will notify you as soon as possible and you may choose to cancel your order, in which case ILC Srl will refund the full amount.

If you unreasonably delay delivery or delay receiving the delivery after ILC has notified you that the carrier has attempted to deliver the items you ordered, or if you have provided ILC with an incorrect delivery address that results in an unsuccessful delivery, the delivery package will be returned to ILC, your order will be canceled, and you will be issued a full refund.

Upon delivery, all officinabvmilano.com orders require confirmation of signature by a person aged 18 or over. You acknowledge that any person who takes delivery of the products at the designated address will be deemed to have done so with your authorization.

14 – RETURNS AND REFUNDS

If for any reason you decide not to keep your online purchases, please carefully review our Returns and Refunds Policy and, before returning the items, contact us at +39 3911740461 or send an email to info@bvmilano.com to obtain a Return Merchandise Authorization (RMA) number.

Please note that ILC Srl will accept goods for a full refund, provided that the item(s) are in their original condition and with all original packaging and attachments. Please take care to return all certificates that accompanied the item, as failure to do so will make you liable for the cost of replacement.

Any associated shipping costs will not be refunded.

Refunds can only be made using the same method used for payment.

The goods must be returned within 19 days (Europe) and within 22 days (outside Europe) from the date of confirmation of shipment, i.e., 14 days after receipt of the item(s).

We cannot accept returns that have been worn, used, altered, or damaged. We reserve the right to refuse the return of any merchandise that does not meet the above return requirements at our sole discretion.

We recommend that you ship returned goods via insured parcel post to enable tracking, as we are not responsible for refunds or compensation in the event that returned parcels are lost, stolen, or mishandled.

All cancellations are carried out in compliance with Italian and European legislation on consumer contracts, i.e., governed by Legislative Decree No. 21 of February 21, 2014, implementing Directive 2011/83/EU on consumer rights and amending the previous Consumer Code referred to in Legislative Decree No. 206 of September 6, 2005.

15. CONSUMER WARRANTY (Warranty)

THIS WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS.

YOU ALSO HAVE OTHER RIGHTS UNDER THE LAW THAT MAY VARY FROM COUNTRY TO COUNTRY.

You can find all the information about your legal rights and remedies by contacting your local consumer advice service. ILC Srl has a legal obligation to supply products that are in conformity with the contract. Nothing in this warranty will replace or reduce any of your legal rights or remedies.

Products sold through the ILC website include a warranty for products that are defective or do not conform to their description during the periods indicated below for various types of products.

The customer is entitled to a warranty on the conformity of the products and services purchased. The warranty is valid for 24 months from the date of delivery of the goods, and any lack of conformity must be reported to ILC within 1 month of discovery.

To exercise the warranty right, the Customer must send an email to ILC srl Co. indicating the order number and a precise description of the defect (we recommend attaching photographic material as well).

The warranty entitles you to request a free repair or replacement if the Products prove to be defective during this period. Under this warranty, ILC Srl may, at its sole discretion, repair your Product or replace it with a Product with identical or similar characteristics. If ILC Srl chooses to repair your Product, it may do so with new or reconditioned parts. If the Product cannot be repaired or replaced within a reasonable time or without inconvenience, you may request a refund or a price reduction. Refunds, if authorized, will usually be made using the same method you originally used to pay for your purchase.

This warranty is given to the original purchaser of the Product from the ILC website – officinabvmilano.com – and is non-transferable, so please keep your order confirmation/invoice or pass it on to the recipient of the gift, as the original proof of purchase is the warranty. If the original receipt or invoice is not available, a credit card or bank statement showing the transaction in question will suffice.

The warranty does not cover normal wear and tear, damage caused by accidents, misuse, and/or mismanagement.

16 – EVENTS BEYOND THE CONTROL OF ILC SRL

ILC Srl shall not be held liable for any delays or failures to perform if the delay or failure is caused by any act, event, accident, or any other occurrence due to mitigating circumstances or beyond its reasonable control, including but not limited to:

civil unrest, riots, invasions, terrorist attacks or threats of terrorist attacks, war (whether declared or not) or threats or preparations for war;
strikes or lockouts (or other union actions);
national or local states of emergency;
interruption or failure of communications or transportation;
power or service outages;
failure by suppliers or subcontractors (other than companies affiliated with ILC Srl);
earthquake, fire, explosion, storm, flood, subsidence, epidemic, or other natural disaster;
inability to use railways, ships, aircraft, motor transport, or other means of public or private transport;
acts, decrees, legislation, regulations, or restrictions of any government.
The term of performance of ILC shall be deemed extended for the entire duration of the above.

17 – LIABILITY

ILC guarantees that all Products purchased from the ILC website – officinabvmilano.com – are of satisfactory quality and reasonably fit for all purposes for which such products are commonly supplied.

These Terms and Conditions of Sale set out the full extent of ILC Srl's obligations and responsibilities in relation to the Products sold through the ILC website under the BV Milano brand. To the extent permitted by applicable law, there are no other warranties, conditions, or terms binding on ILC Srl other than those set out in these Terms and Conditions of Sale.

HOWEVER, NOTHING CONTAINED IN THESE TERMS AND CONDITIONS OF SALE AFFECTS ANY LEGAL RIGHTS OF CONSUMERS UNDER EUROPEAN LAWS.

18 – OBLIGATIONS, Safeguard clause

These General Terms and Conditions of Sale represent the entire agreement between ILC Srl and the User and supersede any previous agreement, understanding, or arrangement between the parties, whether oral or written.

If any provision of these Terms and Conditions of Sale is held to be illegal, void, or for any reason unenforceable by any country or local court of law, that provision shall be deemed severable from these Terms and Conditions of Sale and shall be enforced to the maximum extent permitted by applicable law and shall not affect the validity and enforceability of any of the remaining provisions.

19 – TRANSFER OF RIGHTS AND OBLIGATIONS

These Terms and Conditions of Sale are binding on you and ILC Srl and any other legal entity to which ILC Srl may transfer its rights.

You may not assign your rights or obligations under these Terms to anyone else.

On the contrary, in accordance with the law, ILC Srl may assign, transfer, or otherwise transfer its rights and obligations under these Terms and Conditions to third parties.

20 – WAIVER

These Terms, including the Privacy and Cookie Policy and the Terms and Conditions of Use, constitute the entire agreement between the User and ILC Srl in relation to their subject matter and supersede all previous promises, representations, agreements, statements, and understandings of any kind between the parties.

Our failure to exercise or enforce any right or provision of the Terms shall not constitute a waiver of such right or provision.

21 – APPLICABLE LAW AND JURISDICTION

These Terms and Conditions of Sale and your purchase of Products from the ILC website – officinabvmilano.com – shall be governed by and construed in accordance with Italian law, without recourse to its conflict of law provisions. Any dispute or claim arising out of or in connection with these Terms and Conditions of Sale or your purchase of Products from ILC Srl (including non-contractual disputes or claims) shall be subject to the non-exclusive jurisdiction of the Italian courts.

In relation to this, the competent court is that of Milan.
